Evargana – Natural Rituals

§ 1 Scope

These Terms and Conditions (T&C) apply to all orders placed via our online shop Evargana by consumers and businesses in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). A business is a natural or legal person or a partnership with legal capacity who acts in the course of their commercial or self-employed activity when entering into a legal transaction (§ 14 BGB).

§ 3 Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. Errors excepted.

By clicking the "Buy Now" button, you submit a binding order for the items in your cart. Confirmation of receipt and acceptance of your order will be sent immediately via an automated email.

§ 4 Prices and Shipping Costs

All prices include statutory VAT (where applicable) and other price components.

Additional shipping costs may apply. These are clearly displayed during the checkout process. For more details, see our Shipping Policy.

§ 5 Delivery

We ship worldwide, usually via DHL, Deutsche Post, or a comparable shipping provider. Estimated delivery times are available in our Shipping Policy.

If not all ordered items are in stock, partial deliveries are permitted if reasonable for the customer.

§ 6 Payment

We offer the following payment methods:

• Credit Card
• PayPal
• Shopify Payments (may include Klarna, Sofort, Apple Pay, etc.)

§ 7 Right of Withdrawal

Consumers have a statutory right of withdrawal. Details are available in our Return Policy.

§ 8 Retention of Title

The goods remain our property until full payment has been received.

§ 9 Returns & Exclusions from Withdrawal

Returns are only accepted after prior contact. Products such as opened cosmetics, hygiene items, or custom-made goods are excluded from return. Full details can be found in our Return Policy.

§ 10 Warranty

Statutory warranty rights apply.

For businesses, the warranty period is 12 months from delivery. For consumers, the statutory period of 24 months applies.

§ 11 Liability

We are fully liable for claims due to damages caused by us, our legal representatives, or agents:

• in case of injury to life, body or health
• for intentional or grossly negligent breach of duty
• if we have provided a guarantee (if agreed)

In all other cases, liability is excluded.

§ 12 Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR):

We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 13 Data Protection

Our data protection practices are in accordance with the GDPR. See our Privacy Policy for more details.

§ 14 Place of Jurisdiction and Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumer contracts, this only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has their habitual residence.

For businesses, the place of jurisdiction is our registered office in Regensburg.

§ 15 Final Provisions

If any provision of these Terms & Conditions is or becomes invalid in whole or in part, the remainder of the contract remains valid.
